What happens if the tenant gave an N9 – Tenant’s Notice to End the Tenancy but does not move and does not pay rent?

If the tenant has given an N9 notice to vacate and does not move out according to their notice, you will have to file an application with the Landlord and Tenant Board to get an eviction order based on the notice they gave you. This process can take a few weeks before you recover possession of the rental unit. To apply to the Board based on the notice given by the tenant you will need to submit an L3 Application and a Declaration form.
